在現代國家體制中，圍繞著「法律」此一社會面向上的爭議，經常表現為各種社會改造與變遷發生的最醒目的事件：立法、修法、司法判決與執法，以及針對這些法律事件的倡議、組織、與集體行動。同時，「法治」與科學技術、民主政治等等，共同構築了現代性的想像。本課程以近代台灣的本地經驗為重心，探討法律在社會變遷中的角色。其中介紹的重大課題包括：法律傳統的承繼與改變、成文法系(大陸法系)傳統的特色及其影響、歷年來重大的立法倡議、變遷中的司法體系、司法與行政之間的糾葛、等等。同時，本課程的目的是希望這些知識的探討能夠有助於各種社會運動的實踐。

英文課程概要
English Course Description

Under the modern state system, controversies surrounding the law often appear as the most visible events in the process of social transformation: the making and changing of the law, judiciary decisions and the enforcement of the law, as well as the advocacies, organizing, and collective actions focusing on these issues. In addition, together with technoscience, democracy, and others, the rule of law constitutes significant parts of our imagery of modernity. With contemporary and local experiences in Taiwan as the focal point, this class examines the roles played by the law in social transformation. Major issues introduced include: inheritance and changes of legal traditions, characteristics of the Civil-Law (Continental-Law) tradition and their ramifications, crucial legislations in recent decades, the changing judicial system, and the entanglement between the judiciary and executive powers. The chief goal of this class is for students to apply such inquiries onto their social-movement practices.

本課程以近代台灣的本地經驗為重心，以高度依賴科學知識的毒去請權訴訟為案例，探討法律在社會變遷中的角色以及司法與其他社會機構的互動。其中介紹的重大課題包括：法律傳統的承繼與改變、成文法系(大陸法系)傳統的特色及其影響、歷年來重大的立法倡議、變遷中的司法體系、司法與行政之間的糾葛、等等。同時，本課程的目的是希望這些知識的探討能夠有助於各種社會運動的實踐。
