This course covers the purpose, theories and regulations of the fair trade law.
The topics for discussion include monopolistic enterprises abuse its market power,
controlling the merger of enterprises, prohibiting the concerted action, restricting the price of the resold goods, boycott, discrimination without justification, limiting its trading counterparts’ business activity improperly by means of the requirements of business engagement (for example, restrictive activity in regards to tie-ins, exclusive dealing, territory, customers, use, or otherwise), abuse the coperight and patent to lessen competition or to impede fair competition, prohibiting the counterfeit and other unfair competition. Particular emphasis is placed on the analyzing and criticizing the practice of powe exercised by the Fair Trade Commision as well as the cases of court’s decision about fair trade law, besides, comparative studies are conducted in regard the development of regulations of competition law in USA ,Germany and EU. |
